Accepting these terms

These Terms of Use (“Terms”) are an agreement between you and [Company legal name] (“Budfront,” “we,” “us” or “our”). They apply when you visit or use the Budfront website, including any pages, forms, tools and content we offer on it (the “Site”). By using the Site, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use the Site.

Who can use the site

You must be at least 21 years old, or the legal age to purchase cannabis where you live if that is higher, to use the Site. If you’re using the Site on behalf of a business, you confirm that you have authority to accept these Terms for that business.

Our services

The Site provides information about Budfront’s software for state-licensed cannabis retailers. Budfront does not grow, sell, deliver or handle cannabis.

Dispensaries that subscribe to Budfront are covered by our Dispensary Platform Agreement, which controls if it conflicts with these Terms.
Shoppers who order from a dispensary’s website or app that runs on Budfront are buying from that dispensary, not from Budfront. The dispensary is responsible for its products, prices, orders and policies.

Using the site

As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable and revocable permission to access and use the Site. We may change, suspend or discontinue any part of the Site at any time.

Accounts

Some features, such as the dispensary dashboard, require an account. You’re responsible for keeping your login details secure and for activity under your account. Tell us right away at support@example.com if you believe your account has been accessed without permission.

Intellectual property

The Site and its content, including text, graphics, logos, designs, software and the Budfront name, are owned by Budfront or our licensors and are protected by intellectual property laws. Except for the limited permission above, these Terms don’t give you any rights to them. You may not copy, modify, distribute or create derivative works from the Site without our written permission.

Your submissions

When you submit information through the Site, such as a demo request or feedback, you confirm that it’s accurate and that you have the right to share it. If you send us ideas or suggestions, we may use them without any obligation to you.

Prohibited uses

When using the Site, you agree not to:

Break any law or encourage anyone else to
Submit false information or impersonate any person or business
Interfere with, disrupt or try to gain unauthorized access to the Site or its systems
Scrape, crawl or harvest data from the Site by automated means without our written permission, other than through standard search engine indexing
Reverse engineer or attempt to extract the source code of our software, except where the law allows it
Upload viruses or other harmful code
Use the Site to send spam or unsolicited marketing

Third-party links and services

The Site may link to websites, apps or services that we don’t own or control. We aren’t responsible for their content, policies or practices, and your use of them is at your own risk.

Cannabis laws

Cannabis remains illegal under United States federal law, even in states where it is legal under state law. The Site is intended for use in connection with lawful, state-licensed cannabis businesses only. Nothing on the Site is an offer to sell cannabis, and you are responsible for following the laws that apply to you.

Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, Budfront disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title and non-infringement. We don’t promise that the Site will be uninterrupted, error-free or secure, or that any results, figures or examples shown on the Site will be achieved by your business.

Limitation of liability

To the fullest extent permitted by law, Budfront and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars ($100). Some jurisdictions don’t allow certain limitations, so some of these may not apply to you.

Indemnification

You agree to defend, indemnify and hold harmless Budfront and its affiliates, officers, employees and agents from any claims, damages, losses and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms or of any law.

Governing law and disputes
